EB-1 Visas: Multinational Managers and Executives

Immigration Services for Professionals Seeking Employment-Based (EB) Visas

Immigrating to the United States can be challenging, even if you come at the invitation of a company or organization. However, it can be much easier for high-ranking professionals, as they are often considered priority workers and can be eligible for EB-1 visas.

In order to make the process as streamlined and simple as possible, you will need the help of an experienced immigration attorney. If you are a manager, executive, or other official in a multinational company or organization and wish to work in the U.S., Yekrangi & Associates is here to be your advocate.

Avoiding the Labor Certification Process

In the United States, an employer must typically demonstrate that there is no qualified citizen or U.S. resident to fill a position before hiring someone from out of the country. This is known as the labor certification process and can be lengthy and tedious. However, multination executives and managers are not required to apply for labor certification, which can shorten the immigration process by an entire year.

Applying for a First Preference (EB-1) Visa

According to United States Customs and Immigration Services (USCIS), multinational executives and managers may be able to apply for a First Preference (EB-1) employment-based green card without having to meet the Department of Labor requirements for demonstrating the lack of available U.S. workers for the position.

However, you cannot petition on your own. If you are immigrating on the basis of employment within a company, the company must file a petition for you. They must also bear the burden of proving your relationship to the company and the details of their business in the United States and have been conducting business in the U.S. for at least 1 year.
