EB-1 Visas: Outstanding Professors and Researchers

Skipping the Labor Certification Process

Normally, immigration to the United States for a job would require a U.S. employer to vouch for you and prove that hiring a current U.S. citizen or resident is not a viable option. However, you may be able to skip this part of the process entirely by applying for a First Preference (EB-1) employment-based green card. You may do so if any of the following are true:

  • You are an outstanding professor or researcher with 3 or more years of experience in teaching or research and have been internationally recognized.
  • You are multinational manager or executive and your employer is willing to petition on your behalf.
  • You have what U.S. Customs and Immigration Services (USCIS) would consider extraordinary abilitiesand are coming to the country for a competition, conference, or other event related to your gifting.

Providing Proof of Outstanding Achievement

According to USCIS, you must provide evidence of at least 2 the following in order to qualify for the Outstanding Professor or Research EB-1 Visa:

  • Major prizes or awards for outstanding achievement
  • Membership in associations for people with outstanding achievement
  • Material in professional publications about your work and accomplishments
  • Your participation as a judge of other professionals’ work in your field or a similar field
  • Your original findings, research, and/or contributions to knowledge of your field
  • You authorship of books, articles, or other field-specific publications

As previously stated, only 2 of the above forms of evidence will be required, but keep in mind that USCIS does not treat such evidence as proof that you are immediately eligible for an EB-1 Visa or green card. The department also does not automatically eliminate professionals who do not necessarily fit into the above category and will investigate each case on its own merits.

If you are not sure whether you qualify for status as an Outstanding Professor or Researcher, you may still be eligible for a National Interest Waiver.
