What Is a TN Visa?

The TN Visa is designed for Canadian or Mexican citizens only. Note that you must be a citizen of either Mexico or Canada and not just a permanent resident. You must be offered an employment position in the United States that is "professional." The procedure in which you obtain a TN visa differs for Mexican and Canadian nationals.

What Is a “Professional” under the TN Program?

A "professional" for purposes of a TN visa requires that you have a bachelor’s degree. In addition, the employment category you wish to work in must be listed under the NAFTA Treaty which gave rise to the TN visa.

How Do I Get a TN Visa if I Am a Canadian Citizen?

Canadian citizens can obtain a TN visa by presenting the required documentation at any United States Port of Entry. Most international airports in Canada also have a US Customs and Border Protection Unit which will review your documents prior to issuing you a TN visa.

How Do I Obtain a TN Visa if I Am a Mexican Citizen?

Benefits of a TN Visa

A TN visa has many benefits, namely, the speed in which it can be issued and the lack of a numerical-cap, as opposed to an H-1B. However, unlike an H-1B, the TN visa is not a "dual intent" visa and therefore, can pose some issues if your employer later decides to go through the PERM Labor Certification Process for you. It is possible, however, to obtain PERM Labor Certification while on a TN visa.
