DACA Legal Help in Orange, California

Direct Attorney Guidance for Your DACA Renewal

Changes in federal policy, renewal timing, and immigration history can all affect a DACA request. At Yekrangi & Associates, we work with individuals and families in Orange, California, providing direct access to an immigration lawyer from the beginning of the case through its conclusion.

Our proximity to the USCIS offices serving Orange County and the courthouses in Santa Ana gives us practical familiarity with the agencies involved in local immigration matters. We also appear frequently in Santa Ana immigration court for removal proceedings, which matters when a DACA concern overlaps with a broader immigration or court issue.

Current DACA Rules & Program Limits

USCIS continues to process DACA renewal requests and accompanying work permit applications. It also accepts initial DACA requests, but it doesn’t currently process them. This distinction can determine whether an application will receive agency action under current policy.

Existing DACA grants and related work permits remain valid through their stated expiration dates unless individually terminated. Recipients may work lawfully in the United States while their authorization remains valid.

The general DACA eligibility framework includes:

  • Being under age 31 as of June 15, 2012
  • Having arrived in the United States before age 16
  • Having continuously resided in the country since June 15, 2007
  • Having no felony, significant misdemeanor, or multiple other misdemeanor convictions

USCIS may treat a misdemeanor as disqualifying based on factors involving the offense and sentence. Eligibility requires an individual review because criminal history, departures, prior applications, and other immigration events can affect the analysis.

Work Authorization & Travel Permission
DACA recipients may apply for advance parole for qualifying employment-related, educational, or humanitarian travel abroad. This permission must be requested before departure so an approved traveler can seek reentry. Because approval and the immigration consequences of travel require separate analysis, DACA alone shouldn’t be treated as authorization for international travel.

Limits of DACA
DACA doesn’t grant lawful permanent resident status or create a direct pathway to citizenship. Renewal eligibility, travel history, and possible eligibility for another immigration option involve separate legal questions. We examine each issue rather than treating a DACA approval as the answer to every status concern.

DACA Renewal Requirements in Orange, California

USCIS strongly encourages recipients to file 120 to 150 days before the expiration date on their current approval notice and work permit. We recommend beginning the renewal process about 150 days before expiration to allow time for preparation, mailing, and agency processing.

A renewal request generally requires Form I-821D, Consideration of Deferred Action for Childhood Arrivals; Form I-765, Application for Employment Authorization; and Form I-765WS, the worksheet explaining the applicant’s economic need to work. We organize the required evidence with timelines and supporting letters matched to applicable agency requirements.

A person requesting renewal must generally meet these conditions:

  • They haven’t departed the United States without advance parole on or after August 15, 2012.
  • They have continuously resided in the country since their most recently approved DACA request.
  • They haven’t been convicted of a felony, a significant misdemeanor, or three or more other misdemeanors.

How an Expired DACA Grant Affects Filing

A person whose DACA expired less than one year before filing may submit a renewal request. If it expired at least one year before filing, USCIS treats the submission as an initial request. Although the agency accepts initial requests, it doesn’t currently process them.

The expiration date is therefore central to filing strategy. A legal review can determine whether the submission qualifies as a renewal and whether changes since the last approval require additional evidence or analysis.

How We Prepare a DACA Renewal

We begin by reviewing the client’s work history, family status, travel plans, past entries, and broader immigration history. These facts allow us to assess renewal eligibility, identify filing risks, and consider whether another immigration option warrants separate attention.

We then examine changes since the most recent approval and identify the evidence needed to support the filing. Forms and supporting materials are organized around a clear factual timeline, not reviewed as isolated documents.

If USCIS sends a notice, interview letter, or request for evidence, we explain what it means in plain language. A request for evidence asks for additional documents or information before the agency makes a decision. We clarify what the response must include, when it’s due, and what action comes next.
