What If My F-1 Visa Status Expires Before My Adjustment of Status Interview?

If you have entered the United States lawfully on a valid F-1 (student) visa, it is possible to file Form I-485 to seek an adjustment of status if you have an independent basis, such as through a spouse or through an employer.

What happens if an F-1 visa holder falls out of status while the Form I-485 is still being processed? For example, if the F-1 visa status expires before the adjustment of status interview?

It is important to speak to a lawyer, but generally, if your adjustment of status application was filed before your status expired, you will be deemed “in status” at the time of filing and a subsequent change or expiration of your status will not affect the outcone.
